1. I want to know that after a ring ceremony that we call "SAGAI" can a person talk on phone to his fiancee. If their parents has already given the permission and do not have any objection on that. Both are from different families. 2. Also drinking water while standing is Haram or not. I know a woman who has two girl kids with her first husband. Latter she ran away with a second male few years back. She says ( we doubt her as she is not telling exactly the truth ) she married to that 2nd person , while the 1st male - his original husband was alive and no talaque or qula was pronounced. She separated from the 2nd male also due to some misunderstanding, but she never came to the first husband and mean while her first husband expired. Now again she and the second man started living together. The girls are in our care, and she wants to take them. This is a short back ground. May I know the following under the light of Quran & hadis , what is the fatwa of the esteemed Ulamas :: 1. whteher the nikah between a husband and wife is still valid if the wife or the husband OR any one have illegal relations out side ? 2. Is the nikah with the 2nd male valid, as no talaque or qula was pronounced with the 1st male ? 3. We don?t know actually the nikah has taken place between the 2 nd man and the lady, as the lady is not telling exactly the truth. As an outsider, but just to avoid a sinto be continued between them , can we interfere in this matter ? And can we suggest them to get marry again? 4. Or what is to be done ? 5. What says Uluma-e-Karam in the light of Quran-o-Sunnah: There is a practice in our area according to which Nikah is done in proper Islamic way at the time of engagement but at the time of rukhsati, again Nikah is done in the same way. Uluma doing so admit the fact that once Nikah is done at the time of engagement, it is not necessary to repeat it at the time of rukhsati however they says it is better to repeat it ( or renew it ) at the time of rukhsati. It is necessary to mention here that it is an integaral part of the marriage ceremony in our area to arrange a function of doing nikah on the evening of Shabe-uroosi in which all close relatives participate. So if this function is not done, there would be confusion in the mind of relatives. My question is: ? whether this practice of repeating nikah is according to Quran-o-Sunnah and is there any evidence available in Sunnah. ? Is there any Hadees proving that this practice is forbidden. ? Then in case there is no evidence available in Sunah regarding allowing or disallowing, whether one can be allowed to repeat nikah for the sake of making people?s mind clear.[01 Aug, 2010]
